Building Protected
Covenants
Single
family private residences only.
No store, business, modular
home, mobile home shall be
allowed on the property.
No
main residential building will
have less than 1000 square feet
of floor space, exclusive of
porches, carports or garages.
Residences
must be connected to the TCEQ
State approved water System and
use an aerated septic disposal
system.
Building
structures except property
fences must not encroach on the
easements shown on the plat. No
tract shall be subdivided.
Construction
shall be completed within 180
days of commencement of
construction.
No
metal siding will be allowed on
any residential buildings. Metal
materials used on the roofs of
residences or on sidings or
roofs of outbuildings must have
a minimum 20 year baked enamel
surface. No more than 25% of any
building may be vinyl siding.
Use
Protected Covenants
Tracts
are to be occupied or used for a
private residence for the owner,
his family or guests.
No
owner shall obstruct or permit
the obstruction of the roadway
or utility easement.
No
animals, sheep, livestock or
poultry of any kind shall be
raised, bred or kept on the
property at any time. This
limitation, however, shall not
prohibit dog kennels for
personal use.
No
noxious or offensive activities
shall be carried on or become an
annoyance or nuisance to the
neighborhood.
Tracts
shall never be used as a dumping
ground for rubbish, used lumber,
building materials or unsightly
items.
All
equipment for the storage of
disposal shall be kept in a
clean orderly and sanitary
condition.
No
tents, shacks, barns, nor second
hand house or barracks shall at
any time be used as a residence.
No
storage or disposal of toxic
waste, oil or other toxic fluid
may be maintained on the
property except as is necessary
for private use in boats or
recreational vehicles and under
sound, sanitary, environmental
conditions screened from public
view.
No
removal of sand, or fill dirt
from the property.
Grantee
obligates himself, through the
purchase of a lot, to maintain
the lot in a neat and
presentable manner, at his own
cost and expenses.
Homeowners Association
The
owners of all Lots shall be
required to join the Homeowners
Association
The Homeowners Association
shall have the right but not the
duty to enforce, by proceedings
at law or equity, all
restrictions, conditions,
covenants, fees, dues,
reservations and liens now or
hereafter imposed by the
provisions hereof. The failure
to enforce any covenant or
restriction herein contained
shall in no event be deemed a
waiver of the right to do so
thereafter. Should any
litigation be commenced to
enforce the provisions,
covenants, restrictions, or
other terms hereof or the rights
and duties pertaining thereto by
the home owners association, the
party prevailing in such
litigation shall be entitled, in
addition to such other relief as
may be granted, to a reasonable
sum as and for their attorney’s
fees and court costs.
